Escrow.com: Buy or Sell Online Without the Fear of Fraud

Make sure the Domain Seller gets paid and the Buyer receives the Domain
Buying or selling domains names can be a tricky business when often you have not met and have no previous dealings with the other person in the deal
so no matter if you are the domain buyer or domain seller it is a good idea to use a 3rd Party to act as a middle-man in the transfer of funds and the domain.

The 3rd party service is called a Domain Name Escrow

The 3rd party safely holds a Buyer's payment in a trust account until the entire transaction is complete. This way Buyers can be confident the domain will be registered in their name and Sellers can be sure they'll be paid.

As well as using an Escrow service, you should also consider creating a Non-Disclosure Agreement (NDA) to ensure the details of the transaction are kept private and a Domain Sales Contract, to agree the domain name(s) to be transferred and any other sales details.
NB: Please make sure you enter the exact terms and conditions of your Escrow transaction requirements for the transfer of the domain name or website

For example, the conditions for the transfer of .UK domain might be:

Conditions:
The Domain Name example.co.uk is to be transferred in this agreement.
The BUYER acknowledges that he is eligible to become a registrant (i.e., the domain holder) of a .UK domain. These eligibility criteria are defined by Nominet, the UK governing body for .UK domains. Visit http://www.nominet.org.uk for full details.

All parties agree that once Nominet updates the .UK WHOIS database to show the BUYER as the new Registrant then the trade has completed and the transfer is final. The Buyer / Seller agrees to pay the Nominet transfer fees.

The Nominet WHOIS server is HERE

The Nominet transfer process is defined HERE

The BUYER agrees to pay the Nominet transfer fees (usually £10 + VAT per domain name) as shown HERE

The above conditions are for illustration only and may not be suitable for your transaction. The conditions need to suit the circumstances of your transaction, and they need to be amended to protect you in your transaction. Different domain suffixes have different transfer protocols. Remember to cover every eventuality in your conditions, as you are fully protected by escrow only to the extent that your conditions dictate.
